NH court refuses to reconsider $110M ruling

The Union Leader reports that the New Hampshire Supreme Court has rejected the state’s appeal in the JUA Lawsuit.

The New Hampshire Supreme Court yesterday rejected Gov. John Lynch’s request that it reconsider its decision denying the state the right to use $110 million in malpractice insurance reserves in the state budget.

Doctors, hospitals and other members of the Joint Underwriting Association successfully sued the state to block the funds from being applied toward budgets for 2009, 2010 and 2011.

The court rejected the state’s appeal last month in a 3-2 decision, saying the assets were protected by malpractice insurance contracts .
